TERMS & CONDITIONS FOR USE OF OUR LEARNING MANAGEMENT SYSTEM

Please ensure You read Compassa terms and conditions thoroughly as it governs Your use of Compassa Ltd’s Learning Management System. By enrolling onto a Compassa course You are deemed to have accepted the terms and conditions outlined in this document.

Definitions

In these Conditions the following terms shall have the following meaning:

  • Conditions means these Compassa Ltd Terms and Conditions for Use of our Learning Management System and other relevant terms and conditions of business communicated to you at point of sale.
  • Enrolment Fee means the fee payable by You when You apply to become a student/candidate of Compassa Ltd;
  • Registration and Assessment Fee means the fee payable by You for your NEBOSH assessment.
  • Guide(s) means the guides issued by an “Awarding Body” from time to time in respect of Compassa Ltd Qualifications
  • IOSH means the Institution of Occupational Safety and Health. IOSH Services Limited company registration number 1816826. Address: The Grange, Highfield Drive, Wigston, Leicestershire, LE18 1NN;
  • Malpractice Policy means the latest policy relating to malpractice, which may from time to time be amended;
  • NEBOSH means the National Examination Board in Occupational Safety and Health (a company limited by guarantee under company number 2698100) address: Dominus Way, Meridian Business Park, Leicester, LE19 1QW;
  • LMS means Learning Management System;
  • Assessment means the assessments of practical units and/or examinations which contribute towards Your final qualification;
  • Policies means the policies of Compassa Ltd and Awarding Bodies as amended, updated or added to from time to time;
  • Awarding Body means NEBOSH, IOSH, or other organisation providing accreditation for Qualifications to Compassa Ltd;
  • You or Your refers to You, the student or prospective student for Compassa Ltd Qualifications;

By accepting these terms and conditions you acknowledge that you are about to access the digital content of the course(s) and, as such, You will no longer be entitled to a refund during a Statutory Cancellation Period of 14 days unless:

  • You fail a required English Language Test at the start of course.
  • Your Pre-Course Learning Needs Assessment identifies the course is unsuitable for you.

Enrolments

By enrolling for a qualification with Compassa Ltd (whether You apply directly or whether a third party applies on Your behalf) You accept these Conditions.

Licences for Compassa courses are for a named individual. Once the named individual has been enrolled, the licence cannot be transferred to another person.

Enrolment is for the purposes of identifying You, to Compassa Ltd with whom You are studying, tracking progress through Qualifications, confirming Your eligibility to participate in Awarding Body Assessments and confirming previous units attained by You which count towards Awarding Body Qualifications.

For NEBOSH qualifications and IOSH courses, You are expected to provide a copy of your photographic ID to Compassa in order to complete your course and access your assessments. Failure to provide this photographic ID will result in your being prevented from completing the course or qualification. Your ID document will be deleted at the following times:

  • IOSH: Immediately after we have checked it.
  • NEBOSH: 3 years after passing the qualification.

When enrolling for a qualification You are agreeing to abide by the regulations, policies, and procedures for that qualification, as set out by the Awarding Bodies to that qualification. These are available on the relevant Awarding Body's website. These procedures include their provision of Reasonable Adjustments, Special Considerations, and Malpractice Policy.

Your course access will last according to the time periods below. Once these timeframes have passed, Compassa Ltd reserves the right to suspend your course access and/or delete your account without notice, which will entail the loss of all data including course progress.

  • IOSH Managing Safely: 12 months after your last login or after passing the course, whichever is later. Access can be restored upon request.
  • IOSH Working Safely: 12 months after your last login or after passing the course, whichever is later.  An extension fee is chargeable to restore course access.
  • NEBOSH National General Certificate: 12 months after your last login or 3 years after passing the qualification, whichever is later. Access can be restored upon request.
  • NEBOSH International General Certificate: you will have course access for 2 years after enrolment. Your data will be kept for 3 years after receiving your NEBOSH results. An extension fee is chargeable to restore course access.
  • NEBOSH HSE Introduction to Incident Investigation Award: 12 months after your last login or 3 years after passing the qualification, whichever is later. Access can be restored upon request.
  • NEBOSH HSE Certificate in Managing Stress in the Workplace: 12 months after your last login or 3 years after passing the qualification, whichever is later. Access can be restored upon request.

In the event that Compassa Ltd is unable to supply the services to you, including for reasons such as going into liquidation or administration or loss of accreditation from IOSH or NEBOSH, any liability or refund to you will be limited to course enrolments made in the previous 12 months. No refunds or liability will be incurred by Compassa Ltd for purchases or course enrolments made over 12 months prior to being unable to provide the services.

In the event of Compassa Ltd ceasing its provision of online courses but otherwise continuing to operate, You will have a minimum total of 12 month access, from the date of purchase, before Your access is withdrawn.

Compassa Ltd accepts no responsibility for changes to the availability or syllabus content of the accredited courses as set by the Awarding Body. Should Your syllabus be phased out, at any time during Your study or assessment period, we can only extend this to the last available date for which Your course is valid. Students wishing to transfer to a new syllabus will incur a charge for this as deemed appropriate by us. In the event of changes to the syllabus and assessment criteria, we reserve the right to alter the content or structure of a course without prior notice being given to You.

Eligibility for study

All Compassa Ltd Qualifications are delivered and examined in English (unless specified in the advertised course description).

Should English not be Your first language, it is Your responsibility to ensure that Your proficiency in both written and oral English is of a sufficient standard to enable You to meet the demands of both Your studies and the examination(s).

Compassa Ltd has the right to refuse examination registration for students should you not meet Compassa criteria such as achieving internal milestones on study hours and/or success at defined activities.

Assessments and Reasonable Adjustments

It is Your responsibility to ensure You have registered for the appropriate examination. Compassa Ltd cannot be held responsible for mistakes.

Compassa Ltd’s assessment closing dates are set independently of the Awarding Body.

For assessment registrations received after Compassa Ltd’s closing date, Compassa Ltd reserve the right to refuse acceptance of Your application.

Where Compassa Ltd accept late assessment registrations, an additional charge will apply. Compassa Ltd reserves the right to increase the assessment registration and assessment fees on a periodic basis.

You have the right to apply for reasonable adjustments should You feel You will be at a disadvantage during Your Assessment. The policies for reasonable adjustments are available on the awarding bodies websites.

Your application for reasonable adjustments must be accompanied by substantiated evidence of Your disadvantage.

Your application for reasonable adjustment must be sent to email: will@comepasswithme.co.uk and must be received by Compassa Ltd prior to Your selected examination registration closing date. Your application will be reviewed by Compassa and the relevant Awarding Body. Submission of an application does not commit Compassa or the Awarding Body to agreeing any adjustments to your assessment.

Additional charges may be incurred by You for the implementation of Reasonable Adjustments.

Special Considerations

It is NEBOSH policy that all learners should be given access to fair and equal assessment. Their “Special Considerations Policy” ensures that no learner is placed at an unfair disadvantage, or advantage, over others. In so doing, NEBOSH aims to comply both with legislation intended to prevent unfair discrimination and with the criteria laid down by the regulatory authorities.

IOSH Assessments

A maximum of two attempts is permitted on all IOSH assessments. Failure to pass the assessment within these two attempts will result in you need to resit the full course. No charge will be made for this.

Registering for NEBOSH Assessments

When registering for assessment to a qualification You are agreeing to abide by the regulations for that assessment, as set out in the NEBOSH “Guide” to that qualification.

A partial refund of fees will be made in respect of cancelled registrations only where these qualify under NEBOSH's Refunds Policy. In such cases the fee will be refunded less a deduction as per NEBOSH's refund policy which can be viewed here: https://www.nebosh.org.uk/policies-and-procedures/refunds-policy-and-procedure/ Refunds will not be made in respect of any additional costs incurred by the candidate. 

Fees and registrations are not transferable to alternative examinations or later examination sittings, or between candidates.

Administration charges paid to Compassa are non-refundable in all circumstances without exception.

In the event of Compassa being unable to register You for a NEBOSH assessment due to loss of accreditation by NEBOSH or NEBOSH ceasing to trade, a full refund of the applicable registration and assessment fees will only be payable to the Client for up to 12 months after the Client's payment of these fees. Furthermore, Compassa is not required to refund the course enrolment fee. Instead, Compassa will continue to provide access to the course materials and tutor support as per this agreement for a maximum duration 12 months after giving notice to You of Compassa's inability to register You with NEBOSH due to any of the aforementioned reasons.

Malpractice and Maladministration

Compassa is committed to safeguarding the integrity of its courses, IOSH/NEBOSH qualifications, and meeting its contractual obligations with our awarding bodies.

Malpractice means ‘any act, neglect, default or other practice that is a breach of an awarding body's regulations and/or that:

• compromises, attempts to compromise, or may compromise the process of assessment, the integrity of any qualification, or the validity of a result or certificate; and/or

• damages the authority, reputation or credibility of an awarding body’s qualifications or the wider qualifications community’.

Maladministration means ‘any actions, neglect, default or other practice that compromises the accreditation or quality assurance process, including the integrity of accredited qualifications, the validity of certificates or the reputation and credibility of an awarding body’.

Malpractice and maladministration can be committed by learners, tutors, and learning partners. Compassa actively aims to prevent, detect, and investigate cases of malpractice and maladministration regardless of the identity of the perpetrator. All cases of suspected malpractice and maladministration will be investigated and dealt with in accordance with the policies of the relevant awarding body (i.e. IOSH or NEBOSH).

Examples of malpractice include, but are not limited to:

  • Copying from another learner, or any other person;
  • Using Artificial Intelligence (AI) to research or 
  • Allowing work to be copied, e.g. posting on social networking sites prior to an examination/assessment;
  • Exchanging, obtaining, receiving, passing on information (or the attempt to) that could be examination-related by means of talking, electronic, written or non-verbal communication; 
  • Allowing others to assist in the production of controlled assessments or assisting others in the production of controlled assessments;
  • Collusion: working collaboratively with other learners beyond what is permitted (learner should not let other people see their work as this can lead to accusations of collusion);
  • Using artificial intelligence systems to research or produce answers to controlled assessments;
  • Learning partners or tutors giving improper assistance to learners in the production of controlled assessments

Examples of malpractice involving the misuse of AI include, but are not limited to:

  • Copying or paraphrasing sections of AI-generated content so that the work is no longer the learner’s own;
  • Copying or paraphrasing whole responses of AI-generated content;
  • Submitting work with intentionally incomplete or misleading references or bibliographies;
  • Using AI to complete parts of the assessment so that the work does not reflect the learner’s own research, analysis, evaluation or calculations.

With regards to NEBOSH qualifications, all suspected cases of malpractice will be reported to NEBOSH. These will be investigated by NEBOSH who can, should malpractice be confirmed, impose penalties on the learner(s) including bans from sitting future NEBOSH assessments.

With regards to IOSH courses, all suspected cases of malpractice will be reported to IOSH who may decide to investigate further and impose penalties or take further action.

Compassa reserves the right take action if a learner is found to have committed malpractice. This can include:

  • Not marking any work which has plagiarised or created through malpractice.
  • Reporting learners to the appropriate awarding body.
  • Barring learners who have been found guilty of malpractice by the awarding body, without refund or compensation.

Miscellaneous

Compassa Ltd do not provide any copies of IOSH/NEBOSH parchments/certificates. In the event of a duplicate IOSH/NEBOSH being requested, Compassa Ltd will apply a charge of £50+VAT to cover the cost payable to IOSH/NEBOSH, administration, and postage.

If Your course/qualification is has been paid for by Your employer, Compassa Ltd reserves the right to post the certificates directly Your employer.

If any provision of these Conditions is invalid or unenforceable in whole or in part; the validity of the other provisions of these conditions and the remainder of the provision in question, shall not be affected.

You will communicate with Compassa employees in a respectful and professional way, whether in your telephone, email, social media, or any other form of communication. Compassa reserves the right to delete Your account and course enrolments without refund if You are found to have threatened, harassed, abused, or assaulted any of Compassa's employees.

Data Protection Act

Compassa Ltd will hold personal information about You and will use the information as follows:

  • To process Your applications to Compassa Ltd and administer Your enrolment and registration for Awarding Body Assessments;
  • To respond to requests from employers or employment agencies by providing verification or otherwise of information provided by You to employers or employment agencies of Qualifications gained through Compassa Ltd You hold in connection with applications for employment;
  • To update Your Employer on your results and progress if, and only if, Your Employer is a party to this Contract;
  • To respond to queries raised by You or the Awarding Body;
  • To deal with any disciplinary matters in respect to You;
  • To recover any monies owed by You to Compassa Ltd;
  • To administer Compassa Ltd policies;
  • To notify You of Your Awarding Bodies Assessments results;
  • To liaise with the Awarding Body and exchange information relating to You;
  • To make You aware of services Compassa Ltd and other similar organisations can offer including information on current and future courses and Qualifications unless You have notified us that You have opted out of receiving such information;
  • To carry out research to help Compassa Ltd to improve and plan its Qualifications;
  • For research purposes (in which case Your details will be anonymous); and
  • As otherwise permitted by the Data Protection Act 2018.

You hereby consent to Compassa Ltd emailing Your results to You if it so decides.

You hereby consent to Compassa Ltd featuring Your results on its Learning Management System. In this event Your results will be accessible only to You and Compassa Ltd and identifiable via Your student Username and Password.

Complaints Procedure

In the first instance learners should attempt, if possible and if they feel able to do so, to raise this with their tutor Will Taylor, who will listen to the complaint and do his utmost to resolve this as fast as possible.

If it is not possible to resolve your complaint within the same day, or if the learner prefers to submit a complaint in writing, then it is necessary to email maria@compassa.co.uk with details.

The written complaint will be logged and investigated. Compassa will provide a written response to the complaint along with details on actions taken, within 10 working days of the complaint.

Learners who remain dissatisfied with our response can escalate their complaint to by emailing or writing to the appropriate awarding body

NEBOSH Complaints

IOSH Complaints

Customers wishing to complain directly to IOSH should send an email to Verifiers@IOSH.com within 12 weeks of the incident occurring.

This email should provide details of:

  • the full nature of the complaint (what happened).
  • the date(s) the issue came to your attention (when it happened)
  • the nature of the service affected and/or the IOSH course affected
  • the content and outcome of any investigation carried out by Compassa relating to the issue

If at any point the Training Provider, their staff or delegate wish to be represented legally in relation to any aspect of a complaint, this must be discussed with IOSH, which reserves the right to be represented legally and to act upon legal advice.
